This information does not apply to other websites, pages or online services accessible through hypertext links that may be published in our websites, but referring to resources external to the domain of the Guarantor.

LEGAL BASIS AND PURPOSE OF THE DATA PROCESSING

Consulting our website, personal data relating to identified or identifiable persons may be processed for the following purposes:

  • Ensuring the navigation in the website and creating relevant statistics, as well as managing services and contents in the website; in these cases, the legal basis for data processing is the legitimate interest of the data controller (art. 6, co. 1, let. F of the EU Regulation);
  • Responding to users’ requests (art. 6, co, 1, let. B of the EU Regulation 679/16);
  • Sending general and commercial communications, subjected to users’ consent (art. 6, co, 1, let. A of the EU Regulation 679/16);
  • Sending newsletters, in the case the user has explicitly given their consent (art. 6, co, 1, let. A of the EU Regulation 679/16);
  • Fulfilling obligations deriving from laws, regulations, community legislation. In the last case, legal basis for the data processing is in accordance with a legal obligation to which the controller is subject consent (art. 6, co, 1, let. C of the EU Regulation 679/16);

In the case of processing data collected for purposes that involve the obligation to collect consents from the data subject, these will be collected in pages dedicated to this purpose.

METHOD OF DATA PROCESSING AND DATA RETENTION TIME

Users’ personal data will be processed in compliance with the provisions of the EU Regulation using paper, computer and telematic means, using methods strictly related to the specified purposes, and in all cases guaranteeing security and confidentiality in accordance with the provisions of the EU Regulation.

Data are stored for as long as required by the purpose they have been collected for.

The processing of the collected contact data will last as long as the consent will be expressly withdrawn by the person concerned.

TYPES OF DATA COLLECTION AND PURPOSE OF THE DATA PROCESSING

Submitting optional, explicit and voluntary messages to contact data, as well as filling out and contact forms on the website involve the acquisition of contact data, used for customer service purposes.

Specific privacy notices will be published on specific pages dedicated to services provided by the company. For instance, all the personal data submitted to “Careers” page will be used for recruitment purpose.  For further information about the method of personal data processing, please see the “Privacy” page on this website.

OPTIONAL DATA

The provision of data is optional. Users can therefore decide not to give any data or to subsequently, totally or partially, deny the possibility of processing data already provided: in this case, it may be not possible for the Data Controller to respond to users’ requests.

PLACE OF PROCESSING, CATEGORIES OF RECIPENTS AND TRANFERS OF PERSONAL DATA TO A THIRD COUNTRY

The personal data are processed at the Owner’s operating office and they are processed for the hereinabove purposes by authorized Owner’s staff, employees and partners, in view of their own duties.

The data may be forwarded and processed by partner companies and/or responsible subjects (ex. Ar 28 of the EU Regulation) for the design and/or the maintenance of this website.

The data may be also forwarded to countries inside and outside EU, exclusively for hereinabove purposes.  The transfer of personal data to a third country will anyhow occur in compliance with the Regulation, and hence, in accordance with the regulation of the European Commission on the protection of personal data ensured by the Third Country. Otherwise, it will occur in accordance with specific contracts agreed upon OPT SurgiSystems S.r.l and the Third party or on the ground of the person concerned.

The personal data will not be disclosed.

RIGHTS OF USERS

Users have the right to obtain from the Owner the access to personal data, and the rectification or the erasure of the same ones. Users have also the right to obtain restriction or to object to the processing of their personal data (art. 15 and followings of the Regulation).

The above-mentioned rights may be exercised against the Data Controller by writing to the contact addresses indicated in this website.

RIGHT TO MAKE A COMPLAINT

In the case users thinks that their data processing thorough this website occurs in breach of the Regulation, they have the right to make a complaint to the Guarantor in accordance with art. 77 of the EU Regulation, or to take legal proceedings (art 79 of the Regulation).

This policy on the use of cookies on the website www.opt-ita.com is provided to you in implementation of the measure of the Personal Data Protection Authority dated 8 May 2014 “Identification of simplified methods for the provision of information and acquisition of consent to the use of cookies” and in compliance with Art. 13 of the Privacy Code (Italian Legislative Decree no. 196/2003) and the European Regulation – GDPR 679/2016. WHAT ARE COOKIES?

Cookies are portions of code saved on users’ PCs on the browser used, so as to ensure that the website operates optimally, in accordance with the purposes described in the policy. Some cookies have purposes that may require explicit consent from the user. Cookies, usually present on the browsers of users in a very high number and sometimes also being stored for quite some time, are used for different purposes: to perform computer authentications, for session monitoring, for storing information on specific configurations concerning users who access the server, etc.

a. Technical cookies.

cookie analytics, similar to technical cookies if used directly by the manager of the website to collect information on the number of users and on how they visit that website; functionality cookies, which allow the user to browse based upon a series of selected characteristics and options, such as, for example, language, in order to improve the service rendered to the same. For these cookies, the prior consent of the user is not required.

b. Profiling cookies.

Profiling cookies are used to create profiles relating to users and are used for the purpose of sending advertising messages based upon the preferences shown by users when browsing on the internet. As they are quite invasive within the private sphere of users, European and Italian regulations require users to be informed on the use of the same and to grant consent. Art. 122 of the Privacy Code refers to them and provides that “the archiving of information on the terminal device of a contracting party or user or access to information already archived is permitted only on the condition that the contracting party or user has expressed consent after having been informed by the simplified methods set out in Article 13 of the Privacy Code, Paragraph 3″.

SESSION AND PERSISTENT COOKIES

Session Cookies are limited to your current session of the browser. These cookies are deleted upon closing the browser. Nothing is stored on your computer beyond the time spent using the website (ASP.NET_SessionId and language).

Persistent Cookies (type ASPXANONYMOUS) allow websites to recognise that you are a known user; they have a duration fixed by the website which may vary from a few minutes to several years.

FIRST PARTY AND THIRD PARTY COOKIES

First Party Cookies are created and legible by the website that created them.
Third Party Cookies, on the other hand, are created and legible by domains external to the website and their data is stored at third parties.

They are Remarketing and Behavioural Targeting services connected to Google’s advertising network with the aim of connecting the activity tracked during browsing on the website via Analytics with the AdWords and Doubleclick network, in order to display advertisements as close as possible to the interests of the user.

Court defence
The Personal Data of the User may be used for the defence by the Controller in court or in the phases preparatory to any court case, due to misuse of the same or the related services by the User.
The User declares to be aware that the Controller may be required to reveal Data at the request of the public authorities.

Specific information
At the request of the User, in addition to the information contained in this privacy policy, this Application may provide to the User additional and contextual information regarding specific services, or the collection and processing of Personal Data.

System and maintenance log
For requirements linked to operation and maintenance, this Application and any third party services used by it may collect system logs, i.e. files that record interactions and may also contain Personal Data, such as the IP address of the User.

Information not contained in this policy
Further information in relation to the processing of Personal Data may be requested at any time from the Processing Controller using the contact details.

Exercise of rights by Users
The persons to which the Personal Data refers are entitled at any time to obtain confirmation of the existence or otherwise of the same at the Processing Controller, to know of its content or origin, to verify its accuracy or to request its supplementation, deletion, update, rectification, transformation into anonymous form or block on Personal Data processed in breach of the law, as well as to object in any case, for legitimate reasons, to its processing. Requests should be sent to the Processing Controller.

Changes to this privacy policy
The Processing Controller reserves the right to make changes to this privacy policy at any time, communicating them to the Users on this page. Please therefore consult this page on a regular basis, taking as a reference the date of the latest change identified at the foot of the page. Where you do not accept the changes made to this privacy policy, you are required to cease using this Application and you may request that the Processing Controller removes your Personal Data. Except as otherwise specified, the previous privacy policy will continue to be applied to the Personal Data collected up until that time.

DEFINITIONS AND LEGAL REFERENCES

Personal Data (or Data)
Any information relating to an individual, identified or identifiable, even indirectly, by way of reference to any other information, therein including a personal identification number, constitutes personal data.

Usage Data
This is information collected automatically by this Application (or by the applications of third parties used by this Application), including: IP addresses or domain names of the computers used by Users who connect to this Application, addresses in URI (Uniform Resource Identifier) notation, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response of the server (successful, error, etc.) the country of origin, the characteristics of the browser and the operating system used by the visitor, the various time details of the visit (for example, the time spent on each page) and the details relating to the path followed within the Application, with particular reference to the sequences of pages consulted, to parameters relating to the operating system and the IT environment of the User.

User
The individual who uses this Application, who must be the same as the interested party or be authorised by the latter and whose Personal Data is subject to processing.

Interested party
The individual or legal entity to which the Personal Data refers.

Processing Manager (or Manager)
The individual or legal entity, public administration and any other body, association or organisation put in charge by the Personal Data Processing Controller, in accordance with the provisions of this privacy policy.

Processing Controller (or Controller)
The individual or legal entity, public administration and any other body, association or organisation which is responsible, even together with another controller, for decisions in relation to the purposes, methods of personal data processing and tools used, therein including the security profile, in relation to the operation and use of this Application. The Processing Controller, except as otherwise specified, is the owner of this Application.

The hardware or software tool by which the Personal Data of Users is collected.
